These terms and conditions (the “Terms”) govern your use of our car parks. Please read them carefully. If you do not wish to be bound by the Terms then please do not use our car parks.
In these Terms, the following terms have the following meanings:
1.1 “AELTC” means The All England Lawn Tennis & Croquet Club Limited of ; Church Road, Wimbledon, London, SW19 5AE and its subsidiaries;
1.2 “Car Park(s)” means each parking facility in and around the venue of The Championships, Wimbledon on Church Road, London SW19 managed by (or on behalf of) AELTC and designated for parking Vehicles;
1.3 “DVLA” means the Driver and Vehicle Licensing Agency;
1.4 “Fees” means the fees payable by each User to use a Car Park (as varied by AELTC from time to time), if any;
1.5 “Permit” means a ticket permitting a User to park their Vehicle in a Car Park;
1.6 “PCN” means a parking charge notice requiring a User to pay any unpaid Fees, together with an additional amount representing an estimate of the additional expenses AELTC will incur as a result of such User’s non-compliance (including without limitation debt recovery costs);
1.7 “Tariff Board” means any board or notice at a Car Park displaying the Fees;
1.8 “User” means any individual who uses a Car Park to park a Vehicle; and
1.9 “Vehicle” means any Vehicle used to convey passengers or items that enters a Car Park, including any mechanical device on wheels or tracks, its equipment and accessories.
2 MANAGEMENT AND ENFORCEMENT
2.1 AELTC may contract with subcontractors and agents who have responsibility for management of the roads and Car Parks and surrounding road on AELTC’s behalf and clause 3 shall be construed as applying also to such agents and subcontractors.
3 AELTC’S LIABILITY
3.1 AELTC must operate the Car Park with reasonable skill and care. If AELTC does not, AELTC is only responsible for direct loss or damage a User suffers as a foreseeable result of its breach of its obligations or its negligence or the negligence of AELTC’s employees, agents or subcontractors.
3.2 AELTC does not exclude or limit in any way its liability for death or personal injury caused by its negligence or the negligence of its employees, agents or subcontractors.
3.3 Although AELTC must meet the obligations set out at clauses 3.1 and 3.2, the Car Park is open to others and AELTC cannot guarantee that third parties will not enter a Car Park and cause damage to property and/or engage in criminal activity. Accordingly, each User parks their Vehicle in the Car Park at their own risk. AELTC cannot and do not guarantee the security of the Vehicle and/or its contents.
4.1 Where a Car Park allows the option for Users to pay on entry, the Fees are displayed on a Tariff Board at each Car Park and on AELTC’s website. Each such User is obliged to pay the Fees and to comply with any instructions on the Tariff Board as supplemented by these Terms.
4.2 All Fees (whether pre-paid or pay on entry) should be paid to AELTC in accordance with the instructions issued by AELTC from time to time.
5.1 Each Permit is valid only for the Vehicle in respect of which it is issued. A Permit does not entitle a User to use any particular space in a Car Park or to priority over other Users.
5.2 All Permits remain the property of AELTC.
5.3 A User is required to display their Permit prominently in their Vehicle at all times when in a Car Park. If the printed information on the Permit is obscured or if the Permit cannot be seen clearly from outside the Vehicle, AELTC will assume that the User does not hold a valid Permit to park in the Car Park.
6 CLAIMS AND COMPLAINTS
6.1 If a Vehicle sustains damage while in a Car Park, a Vehicle is stolen or any possessions are stolen from a Vehicle while it is in a Car Park the User should immediately:
(a) inform either a Car Park attendant or otherwise notify a Car Park attendant or AELTC using the contact details available at wimbledon.com;
(b) in the case of theft, inform the police; and
(c) notify the User’s insurers.
6.2 Any claims against AELTC or complaints about the service the User has received, should be addressed to AELTC. The contact details are available at wimbledon.com. In the case of a claim, full details should be provided to AELTC as soon as possible.
7 PARKING CONTRAVENTIONS
7.1 It is important for the effective management of each Car Park that each User:
(a) complies with all signs in a Car Park, including these Terms and the Tariff Board;
(b) parks within the limits of a marked bay;
(c) does not park within a bay designated for a specific purpose when they are not entitled to do so (for example, and without limitation, parking in a space designated for disabled persons without an appropriate disability badge displayed, and/or parking in a space for electric vehicles when such User is not using the charging facility);
(d) pays all Fees; and
(e) displays the requisite Permit.
7.2 If a User does not comply with these requirements AELTC (or its subcontractors and agents) may issue such User with a PCN.
7.3 Information relating to how to pay the PCN, deadlines for payment, what will happen if a User fails to make payment within the stipulated deadline, and the appeal process will be set out on the PCN.
7.4 If the Car Park and/or the equipment in the Car Park is damaged by a User, a User’s Vehicle, its contents or the passengers in such Vehicle then, except where the damage arises as a direct result of AELTC’s negligence, AELTC reserves the right to recover the cost of that repair and associated administration costs from such User.
8 SAFETY AND SECURITY
8.1 Each User must:
(a) drive carefully and strictly observe any speed limits;
(b) not leave a Vehicle overnight in any of the Car Parks;
(c) beware of Vehicles in motion;
(d) comply with all directions and signs from time to time posted in the Car Park and all instructions or requests given or made from time to time by AELTC’s employees, servants or agents for regulating traffic and controlling the positioning of Vehicles in the Car Park;
(e) ensure that the Vehicle is securely locked;
(f) ensure that all the windows of the Vehicle are securely locked;
(g) ensure that the brakes are applied as appropriate for the parking mode of the Vehicle;
(h) ensure that, if the Vehicle is fitted with a steering lock or similar device that it is engaged; and
(i) and ensure that no person or animal is left in the Vehicle.
8.2 AELTC is not responsible for any consequence or loss arising from a failure by a User to properly secure their Vehicle.
8.3 AELTC may install CCTV cameras in the Car Parks at its discretion to assist in its proper running. By parking a Vehicle in a Car Park each User consents to AELTC (and its subcontractors) capturing, using and processing their Vehicle, Vehicle registration number and their personal details via CCTV for safety and security purposes. This includes AELTC’s right to request and obtain the details of a Vehicle’s registered keeper from the DVLA. AELTC acknowledges that the CCTV may act as a deterrent to criminal activity, but does not make any representation as to the coverage provided or guarantee of the security of a Vehicle if CCTV is installed in a Car Park.
8.4 AELTC reserves the right to search Vehicles both prior to entry into the Car Park and within the Car Park for safety and security purposes and, in this connection, each User shall comply with the reasonable instructions of AELTC.
Any possessions left in a Vehicle are left entirely at the owner’s risk. AELTC suggests that no items are left so that they are visible from the outside of the Vehicle. AELTC is not liable for any theft by third parties from a Vehicle.
10 TRAFFIC ORDERS AND BYELAWS
The use of a Car Park may be regulated by traffic orders or byelaws under which a penalty may be payable for failing to comply with these Terms or the requirements of the relevant order or byelaw. In such circumstances, separate notices specifying the relevant order or byelaw will be displayed in the Car Park and AELTC reserves the right to take enforcement action against a User (including through court proceedings) for breach of such order or byelaws.
11 ACCESS AND RELOCATION OF VEHICLES
11.1 AELTC reserves the right to:
(a) refuse the admission of any Vehicle to a Car Park for any reason whatsoever;
(b) move Vehicles within the Car Park using whatever method AELTC considers appropriate (even if, as a consequence, damage is caused to a Vehicle) to the extent that is reasonably necessary for the purposes of safety to persons or property, or to avoid obstruction at the Car Park; and
(c) remove any Vehicle from a Car Park due to a matter outside of AELTC’s control, or if the Car Park has to be evacuated in an emergency.
11.2 To the extent that it is necessary to do so in the exercise of the rights conferred upon AELTC in this clause 11, AELTC reserves the right to drive or otherwise take a Vehicle onto a public highway. In doing so AELTC will take reasonable care of the Vehicle.
12 ABANDONED VEHICLES
12.1 AELTC is entitled to regard as abandoned any Vehicle left in the Car Park beyond the permitted time as specified on the Permit.
12.2 AELTC reserves the rights to engage and/or permit a lawful authority to remove (or where AELTC is unable to identify the current legal registered keeper of the Vehicle, to take steps ourselves to remove) any abandoned Vehicle.
12.3 AELTC reserves the rights to engage and/or permit a lawful authority to dispose of as waste or sell any abandoned Vehicle after 28 days. Before proceeding with the disposal or sale of abandoned Vehicles AELTC will:
(a) refer the matter to the appropriate authorities, which may include the local police and the DVLA; and
(b) affix a notice to the Vehicle at least 7 days before the date on which AELTC proposes to remove the Vehicle stating that the Vehicle will be removed and sold when that period expires.
12.4 Abandoned Vehicles may be disposed of as waste or sold by auction. Where sold by AELTC, the proceeds of sale will be applied in and towards satisfaction of all sums owing to AELTC together with the expenses of sale and AELTC’s reasonable storage and removal costs for the period during which the Vehicle is in AELTC’s possession.
12.5 Any balance of the sale proceeds remaining after satisfaction of any sums owing will be held by AELTC on behalf of the registered keeper of the Vehicle and paid over on proof of entitlement.
13 PROHIBITED ACTIVITIES
13.1 A User must not tow any Vehicle into a Car Park except as part of the services offered at the Car Park by persons authorised by AELTC and no work on and no cleaning of Vehicles by a User or their agent, other than with AELTC’s prior specific permission, is permitted in a Car Park. In the event of Vehicle breakdown the affected User must contact the Car Park attendant to ensure that their Vehicle removal or repair is organised without causing disruption, damage or danger to any other person or property in the Car Park.
13.2 No activity in connection with the selling, hiring or other disposal of Vehicles or goods or services may be carried out in a Car Park without AELTC’s prior specific written permission.
13.3 A User is not allowed to dispose of any items or drop litter in the Car Park. Instead a User should place any litter in the bins that are provided or take it away with them when they leave the Car Park.
13.4 A User is not allowed to pour petrol, or any other fuel, into their Vehicle whilst it is in a Car Park. A User is also not allowed to take petrol, or any other fuel, out of their Vehicle whilst it is in a Car Park.
13.5 Smoking is forbidden within both a Car Park and the immediate vicinity of a Car Park.
13.6 Anti-social behaviour will not be accepted in the Car Parks. Car parks are designed for the sole purpose of parking Vehicles. If a User causes a nuisance or disturbance to others it may be recorded by CCTV cameras and action may be taken against them.
13.7 A User should not take photos or carry out any filming within the Car Park without AELTC’s written consent.
14 WAIVER AND VARIATION
Any waiver by AELTC of a breach of any provision of these Terms will not be considered as a waiver of any subsequent breach of the same or any other provision. No oral variation of these Terms will be binding.
Each of these clauses in these Terms operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining clauses will remain in full force and effect.
16 GOVERNING LAW AND JURISDICTION
16.1 This Terms and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the law of England and Wales.
16.2 The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms or their subject matter or formation (including non-contractual disputes or claims).
