The All England Lawn Tennis Club (Championships) Limited (“AELTC”, “We”, “Us”, “Our”) presents to you Our websites (each, an “AELTC Website”) and mobile applications (each, an “AELTC App”), including such digital services, content and software as may be made available for use on them from time to time (the “Services”) (the foregoing collectively referred to herein as the “AELTC Digital Platforms”).
1 Information about us
AELTC is the organisation responsible for the day-to-day planning and staging of The Championships, Wimbledon (“The Championships”). AELTC is registered in England and Wales under company number 07546773 with its registered office at The All England Lawn Tennis Club, Church Road, Wimbledon, London, SW19 5AE.
2 Acceptance of these Terms of Use
2.1 These terms of use (the “Terms of Use”) inform you of the terms and conditions by which you may make use of the AELTC Digital Platforms. By accessing, downloading, installing and/or using any of the AELTC Digital Platforms, whether or not you register for an account with Us, you acknowledge that you have read, understood and agree to be bound by these Terms of Use.
2.2 Please read these Terms of Use carefully before using any of the AELTC Digital Platforms. If you do not agree to these Terms of Use, you must not use the AELTC Digital Platforms.
3 Other applicable terms
3.1 These Terms of Use refer to the following additional terms, which also apply to your use of some or all of the AELTC Digital Platforms and/or such Services which may be offered on them:
3.1.1 AELTC’s Privacy Policy, which sets out the terms on which AELTC and its group companies process any personal data that We/they collect from you, or that you provide to Us/them. By using the AELTC Digital Platforms, you consent to such processing and you warrant that all data provided by you is accurate;
3.1.2 AELTC’s General Cookie Policy, which sets out information about how we use cookies on the AELTC Digital Platforms;
3.1.3 AELTC’s Online Sale of Goods Terms and Conditions, which apply to your purchase of any goods from Our online shop(s);
3.1.4 AELTC’s Ballot Terms and Conditions, which apply to your application for any spectator ticket(s) to The Championships via the ballot;
3.1.5 AELTC’s Ticket Terms and Conditions, which apply to the online purchase and subsequent use of spectator ticket(s) to The Championships, and AELTC’s Conditions of Entry, which apply to entry to the venue of The Championships; and
3.1.6 Such other applicable terms and conditions which may be brought to your attention from time to time in relation to your use of an AELTC Digital Platform or Service.
3.2 In order to download and use an AELTC App, you will first be required to have either a Google Play Store account or an Apple ID on the Apple App Store. Your use of the Google Play Store and of the Apple App Store is governed, respectively, by separate terms and conditions with the relevant Google affiliate or Apple affiliate. Your access to and use of an AELTC App remains subject to you having agreed to and complying with such applicable terms and conditions. Notwithstanding any conflict between such terms and conditions and these Terms of Use in relation to your use of an AELTC Digital Platform, the provisions of these Terms of Use shall take precedence.
4 Changes to these Terms of Use
AELTC reserves the right to modify, revise or otherwise update these Terms of Use at any time. Please ensure that you review the Terms of Use regularly, including each time that you use an AELTC Digital Platform to take notice of any changes AELTC has made to them, as they will be binding on you.
5 Nature of content on AELTC Digital Platforms
5.1 The content on the AELTC Digital Platforms is provided for general information only.
5.2 Although AELTC makes reasonable efforts to update the information on the AELTC Digital Platforms, We make no representations, warranties or guarantees, whether express or implied, that any information displayed on any AELTC Digital Platform is accurate, complete or up-to-date, nor do We guarantee that the AELTC Digital Platforms, or any content on them, will be free from errors or omissions.
5.3 AELTC reserves the right to make changes to the format and content of the AELTC Digital Platforms from time to time at Our discretion.
5.4 AELTC does not guarantee that any AELTC Digital Platform will be secure or free from bugs or viruses. You are responsible for configuring your information technology, computer programmes and platforms in order to safely access the AELTC Digital Platforms, including using your own up-to-date virus protection software.
5.5 Where an AELTC Digital Platform contains links to other websites and resources provided by third parties, these links are provided for your information only. AELTC has no control over the contents of those websites or resources.
6 Intellectual property rights
6.1 Save for any User Content (as defined in Section 14.1 below) appearing on an AELTC Digital Platform, AELTC is the owner or the licensee of all intellectual property rights in the AELTC Digital Platforms, and in the material published on them. Those works are protected by copyright laws and treaties around the world. All such rights are reserved.
6.2 You must not use any part of or any content obtained from an AELTC Digital Platform for commercial purposes without first obtaining a licence from AELTC or from AELTC’s official licensors (as may be applicable). Without prejudice to the foregoing, if you do wish to make any use of any content on an AELTC Digital Platform, please Contact Us.
6.3 You may print one copy of, and/or may download extracts of, any page(s) from an AELTC Website or AELTC App provided that: (i) such extracts are used only by you for personal, non-commercial purposes; (ii) such action is not otherwise in breach of any other applicable terms and conditions (for example, AELTC’s Ticket Terms and Conditions); and (iii) the relevant AELTC Website or AELTC App does not otherwise prohibit such activities.
6.4 You must not modify the paper or digital copies of any materials you have printed or downloaded in any way, and you must not use any illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text.
6.5 If you print, copy or download any part of an AELTC Digital Platform in breach of these Terms of Use, your right to use the AELTC Digital Platform will cease immediately and you must, at AELTC’s option, return or destroy any such copies of the materials you have made.
6.6 Without prejudice to Sections 6.2 and 6.3 above, AELTC’s status (and that of any identified contributors) as the author of content on an AELTC Digital Platform must always be acknowledged.
7 AELTC marks
AELTC and members of AELTC’s group (which means AELTC’s subsidiaries, AELTC’s ultimate holding company and its subsidiaries, as defined in section 1159 of the UK Companies Act 2006) own a number of trade marks in numerous territories, including but not limited to the word mark THE CHAMPIONSHIPS WIMBLEDON and the Wimbledon crossed-rackets logo (collectively, the “AELTC Marks”). Other than as may be permitted by Section 12 below, you agree that you shall not use or display any AELTC Marks in any manner without first obtaining the prior written authorisation of AELTC.
8 Accessing the AELTC Digital Platforms
8.1 AELTC does not guarantee that the AELTC Digital Platforms, or any content on them, will always be available or uninterrupted. Access to the AELTC Digital Platforms is permitted on a temporary basis. AELTC may suspend, withdraw, discontinue or change all or any part(s) of an AELTC Digital Platform without notice. AELTC will not be liable to you if for any reason an AELTC Digital Platform becomes unavailable at any time or for any period.
8.2 You are responsible for making all arrangements necessary for you to have access to the AELTC Digital Platforms.
8.3 You are also responsible for ensuring that any person who accesses the AELTC Digital Platforms through your internet connection and/or any of your devices is made aware of these Terms of Use and other applicable terms and conditions referred to in these Terms of Use, and that they comply with them at all times.
9 Account registration
9.1 In order to access certain restricted Services and/or areas of some of the AELTC Digital Platforms, you will first be required to register for an account with Us. The information you are required to provide to Us in order to register for an account is governed by our Privacy Policy. By providing such information you agree: (i) only to provide true, accurate and complete information about yourself; and (ii) to maintain and promptly update such information in order to keep it true, accurate and complete.
9.2 Certain restricted Services on the AELTC Digital Platforms may permit you to register and sign-in to them by using your account or registration details with a third party service provider (for example, by using your Facebook account to login to myWimbledon or your LinkedIn account to login to jobs.wimbledon.com). Your ability to sign-in to a Service this way will be governed by the terms and conditions between you and the third party service provider. You should remind yourself of such terms and conditions before signing in to any Service using such details.
9.3 By registering for any such restricted Service, you acknowledge and warrant that: (i) where applicable, you meet the minimum age limit and/or other eligibility requirement(s) to access the restricted Service and/or area; (ii) the information you include as part of the account registration process is accurate and not misleading; and (iii) you are prohibited from having, and you shall not take any steps in creating, more than one account for any given AELTC Digital Platform at any given time.
9.4 If at any time We have reasonable grounds to believe that you have provided any information that is false or misleading, or that you have otherwise not complied with these Terms of Use, We reserve the right to temporarily or permanently deactivate or delete your account and/or to immediately withdraw your right to use the AELTC Digital Platform for which an account is required.
10 Account security
10.1 You are at all times responsible for maintaining the confidentiality of your account details (including your password) and for all activities that occur under your account. You further agree that you will sign out of your account at the end of each session.
10.2 You agree to immediately notify AELTC of any unauthorised use of your account or password or any other related unauthorised activities in connection with your account. You acknowledge that AELTC shall not be liable for any loss or damage arising from your failure to comply with these obligations.
11 Prohibited uses
11.1 You may use the AELTC Digital Platforms only for lawful purposes. You may not use the AELTC Digital Platforms:
11.1.1 in any way that breaches any applicable local, national or international law or regulation;
11.1.2 in any way that is unlawful or fraudulent, or has any unlawful or fraudulent purpose or effect;
11.1.3 for the purpose of harming or attempting to harm minors in any way;
11.1.4 to send, knowingly receive, upload, download, use or re-use any material which does not comply with Our Content Standards (as described at Section 15 below); or
11.1.5 to transmit, or procure the sending of, any unsolicited or unauthorised advertising or promotional material or any other form of similar solicitation (spam).
11.2 You agree not to reproduce, duplicate, copy or re-sell any part of an AELTC Digital Platform in contravention of these Terms of Use.
11.3 You must not attempt to gain unauthorised access to any part of an AELTC Digital Platform, the server on which an AELTC Digital Platform is stored or any server, equipment or network connected to any AELTC Digital Platform.
11.4 You must not access without authority, interfere with, damage or disrupt any software used in the provision of an AELTC Digital Platform or any equipment, network or software owned or used by any third party in connection with an AELTC Digital Platform.
11.5 You must not make use of any technological, automated or manual processes in order to circumvent or manipulate the intended functionality of any Service on an AELTC Digital Platform, in particularly (but without limitation) in order to gain an unfair and/or unauthorised advantage to accessing tickets to The Championships.
11.6 You must not misuse, damage or disrupt any AELTC Digital Platform by knowingly introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful. You must not attack an AELTC Digital Platform via a denial-of-service attack or a distributed denial-of service attack. By breaching this provision, you may be committing a criminal offence under the Computer Misuse Act 1990. AELTC may report any such breach to the relevant law enforcement authorities and AELTC will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use the AELTC Digital Platform will cease immediately.
12 Linking to an AELTC digital platform
12.1 You may only establish a link to an AELTC Digital Platform on the condition that such link accurately reflects the page of the AELTC Digital Platform to which you are linking and is in no way unfair, misleading, defamatory or otherwise risks damaging the reputation of, or taking advantage of, the good name and goodwill of AELTC and/or The Championships.
12.2 You must not establish a link in such a way as to suggest any form of association, approval or endorsement on the part of AELTC and/or The Championships where one does not exist.
12.3 You must not frame an AELTC Digital Platform on any other website.
12.4 AELTC reserves the right to withdraw linking permissions without notice.
13 Interactive services
13.1 AELTC may from time to time offer interactive Services on some of the AELTC Digital Platforms, including, without limitation, chat rooms, review features and/or bulletin boards (each, an “Interactive Service”).
13.2 Where AELTC does offer any Interactive Service, We will provide clear information to you about the kind of Interactive Service offered, if it is moderated and what form of moderation is used (including whether it is human or technical).
13.3 AELTC will take all reasonable steps (including such steps required by applicable law) to assess any possible risks for users (in particular, for children) from third parties when they use any Interactive Service provided on an AELTC Digital Platform, and We will decide in each case whether it is appropriate to use moderation of the relevant Interactive Service (including what kind of moderation to use) in light of those risks. However, We make no representation or warranty that any Interactive Service which We offer on any AELTC Digital Platform will be moderated at any given time or that such AELTC Digital Platform will be completely free from harm. To the maximum extent permitted by applicable law, We expressly exclude Our liability for any loss or damage arising from the use of any Interactive Service by a user in contravention of Our Content Standards, whether the Interactive Service is moderated or not.
13.4 If you are a minor, before using any Interactive Service you must first inform and obtain permission from your parent(s) or legal guardian. AELTC advises parents who permit their children to use any Interactive Service that it is important that they communicate with their children about their safety online, irrespective of whether an Interactive Service is moderated. Minors who use any Interactive Service should be made aware of the potential risks to them.
13.5 Where AELTC does moderate the Interactive Service, We will normally provide you with a means of contacting the moderator, should a concern or difficulty arise.
14 User content
14.1 Whenever you make use of a feature that allows you to upload content and/or material to an AELTC Digital Platform (“User Content”), which may include making contact with other users of an AELTC Digital Platform, you must comply with Our Content Standards (as set out in Section 15 below).
14.2 You warrant that any such User Content shall comply with Our Content Standards, and you will be liable to AELTC and indemnify AELTC for any third party claims, loss or damage arising from any breach of that warranty. If you are a consumer, this means you will be responsible for any loss or damage AELTC suffers as a result of your breach of warranty.
14.3 Any User Content will be considered non-confidential and non-proprietary. You retain all of your ownership rights in your content, but you hereby grant to AELTC a perpetual, worldwide, non-exclusive, irrevocable, royalty-free, transferable licence to use, reproduce, distribute, prepare derivative works of, display, and perform such User Content for any purpose across all media whether now known or hereinafter invented and you warrant that you have all applicable licences and/or permissions required for Us to use your User Content accordingly.
14.4 AELTC also has the right to disclose your identity to any third party who is claiming that any User Content posted or uploaded by you to an AELTC Digital Platform constitutes a violation of their intellectual property rights, or of their right to privacy.
14.5 To the maximum extent permitted under applicable law, AELTC accepts no responsibility, or liability to any third party, for the content or accuracy of any User Content posted by you or any other user of an AELTC Digital Platform.
14.6 AELTC has the right to immediately remove any posting you make on an AELTC Digital Platform if, in AELTC’s sole opinion, your post does not comply with Our Content Standards.
14.7 The views expressed by other users on an AELTC Digital Platform do not represent AELTC’s views or values.
15 Content standards
15.1 AELTC sets certain standards which apply to any and all User Content which users may contribute to the AELTC Digital Platforms from time to time, and to any Interactive Services associated with them (the “Content Standards”).
15.2 You must comply with the spirit and the letter of Our Content Standards as set out below. The Content Standards apply to any User Content as a whole as well as to any part or parts of it.
15.3 User Content must:
15.3.1 be accurate (where it states facts);
15.3.2 be genuinely held (where it states opinions); and
15.3.3 comply with applicable law in the United Kingdom and in any country from which it is posted.
15.4 User Content must not:
15.4.1 contain any material which is defamatory of any person;
15.4.2 contain any material which is obscene, offensive, hateful or inflammatory;
15.4.3 promote sexually explicit material;
15.4.4 promote violence;
15.4.5 promote discrimination based on race, sex, religion, nationality, disability, sexual orientation or age;
15.4.6 infringe any copyright, database right or trade mark of any other person;
15.4.7 be likely to deceive any person;
15.4.8 be made in breach of any legal duty owed to a third party, such as a contractual duty or a duty of confidence;
15.4.9 promote any illegal activity;
15.4.10 be threatening, abuse or invade another’s privacy, or cause annoyance, inconvenience or needless anxiety;
15.4.11 be likely to harass, upset, embarrass, alarm or annoy any other person;
15.4.12 be used to impersonate any person, or to misrepresent your identity or affiliation with any person;
15.4.13 give the impression that it emanates from Us, if this is not the case;
15.4.14 advocate, promote or assist any unlawful act such as (by way of example only) copyright infringement or computer misuse; or
15.4.15 contain any material that is otherwise illegal in nature,
16 Non-compliance with these Terms of Use
16.1 Failure to comply at any time with these Terms of Use may result in AELTC taking all or any of the following actions at Our discretion:
16.1.1 Issuance of a warning to you;
16.1.2 Immediate, temporary or permanent withdrawal of your right to use the AELTC Digital Platforms;
16.1.3 Immediate, temporary or permanent deactivation or deletion of any account you have on an AELTC Digital Platform;
16.1.4 Immediate, temporary or permanent removal of any User Content uploaded by you to the AELTC Digital Platforms;
16.1.5 Legal proceedings being issued against you for reimbursement of all costs on an indemnity basis (including, but not limited to, reasonable administrative and legal costs) resulting from your breach of these Terms of Use;
16.1.6 Further legal action against you;
16.1.7 Disclosure of such information to law enforcement authorities as AELTC reasonably feels is necessary; and/or
16.1.8 Such other actions as may be set out in these Terms of Use and/or as AELTC deems reasonably appropriate.
16.2 Any action taken by AELTC relating to your ability to access the AELTC Digital Platforms or an account you have on an AELTC Digital Platform as set out above shall not affect any legal or contractual rights and obligations which may apply to you resulting from you having purchased tickets or any goods or services from Us via an AELTC Digital Platform. The terms and conditions applicable to your purchase of such tickets, goods or services shall continue to apply (which, for the avoidance of doubt, may include compliance with these Terms of Use).
17 Limitation of AELTC’s liability
17.1 Nothing in these Terms of Use excludes or limits AELTC’s liability for death or personal injury arising from AELTC’s negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by English law.
17.2 To the extent permitted by applicable law, AELTC excludes all conditions, warranties, representations or other terms which may apply to the AELTC Digital Platforms or any content on them, whether express or implied.
17.3 AELTC will not be liable to you for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with:
17.3.1 use of, or inability to use, an AELTC Digital Platform; or
17.3.2 use of or reliance on any content displayed on an AELTC Digital Platform.
17.4 If you are a business user, please note that in particular, AELTC will not be liable for:
17.4.1 loss of profits, sales, business, or revenue;
17.4.2 business interruption;
17.4.3 loss of anticipated savings;
17.4.4 loss of business opportunity, goodwill or reputation; or
17.4.5 any indirect or consequential loss or damage.
17.5 If you are a consumer, please note that AELTC only provides the AELTC Digital Platforms for domestic and private use. You agree not to use any AELTC Digital Platform for any commercial or business purposes, and AELTC has no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.
17.6 AELTC will not be liable for any loss or damage caused by a virus, distributed denial-of-service attack, or other technologically harmful material that may infect your computer equipment, computer programmes, data or other proprietary material due to your use of any AELTC Digital Platform or to your downloading of any content on it, or on any website linked to it.
17.7 AELTC assumes no responsibility for the content of websites linked on any AELTC Digital Platform. Such links should not be interpreted as an endorsement by AELTC of those linked websites. AELTC will not be liable for any loss or damage that may arise from Your use of them.
18 General provisions
18.1 In these Terms of Use, words importing the singular include the plural and vice versa and words importing a gender shall be interpreted to mean any gender. Any words following the term ‘including’, ‘such as’, ‘for example’ or similar shall be construed without limitation.
18.2 Unless the context dictates otherwise, any reference to a ‘person’ in these Terms of Use shall be interpreted as referring to natural or legal persons.
18.3 In the event that any of the provisions of these Terms of Use conflicts with the provisions of any third-party terms of service on the AELTC Digital Platforms, the provisions of these Terms of Use shall prevail.
18.4 Any failure by AELTC to exercise or enforce any right or provision of these Terms of Use shall not be deemed a waiver of such right or provision.
18.5 If any part of these Terms of Use is found unlawful or unenforceable, it will be deemed deleted and nothing shall affect the validity of the remainder of these Terms of Use, which shall continue to apply to you.
19 Applicable law
19.1 If you are a consumer, please note that these Terms of Use and the subject matter and formation of these Terms of Use, are governed by English law. All disputes in connection with these Terms of Use shall be resolved by the courts of England and Wales. However, if you are a resident of Northern Ireland you may also bring proceedings in Northern Ireland, and if you are resident of Scotland, you may also bring proceedings in Scotland.
19.2 If you are a business user, these Terms of Use, their subject matter and their formation (and any non-contractual disputes or claims) are governed by English law and the courts of England and Wales shall have exclusive jurisdiction.
19.3 Notwithstanding the foregoing, We reserve the right to take legal action in any jurisdiction in order to protect and enforce Our intellectual property rights.
